Filing an Amicus Curiae Brief

The Jeanne A. Carpenter Epilepsy Legal Defense Fund files amicus curiae, or friend of the court,  briefs in selected cases. Due to limited resources, we cannot file a brief in every case. In deciding whether to file a brief, the following criteria will be considered:

  • Will the case establish a precedent at the state or federal level?
  • Does the case involve clearly defined legal issues rather than questions of fact?
  • Is the case at the appellate, rather than trial, level?
  • Does the outcome of the case directly impact persons with epilepsy?
  • Does the case advance a position previously adopted by the Epilepsy Foundation?
  • Does the case present an issue on which the Fund can provide a unique perspective?
  • Are sufficient resources available?

Regardless of whether or not the case meets any or all of the criteria listed, neither the Epilepsy Foundation nor the Jeanne A. Carpenter Epilepsy Legal Defense Fund can guarantee its participation in any particular case. In addition, the absence of one or more of these factors will not preclude the Fund from becoming involved in a particular case.
